Rideshare (Uber/Lyft) Wrecks: Which Insurance Applies and When

Rideshare (Uber/Lyft) Wrecks: Which Insurance Applies and When

Rideshare wrecks create one big question: Whose insurance applies? The answer depends heavily on the driver’s app status at the time of the crash. That is why one of the first things we do is lock down the timeline.

Texas requires specific insurance coverage for rideshare periods

Texas Insurance Code Chapter 1954 sets minimum coverage rules for transportation network company drivers and companies.

When the app is off

If the driver is not logged into the rideshare network, it is usually treated like ordinary driving and the driver’s personal auto policy is typically the starting point.

When the app is on and the driver is waiting

Texas law requires minimum liability coverage during the period when the driver is logged on and available but not engaged in a prearranged ride. The statute lists minimum amounts of $50,000 per person, $100,000 per incident, and $25,000 for property damage.

When the driver has accepted a trip or is transporting a rider

When the driver is engaged in a prearranged ride, Texas law requires a total aggregate liability limit of $1 million for death, bodily injury, and property damage.

Uber and Lyft also describe how coverage applies based on whether the driver is offline, online, or on a trip.

Common rideshare coverage problems

The carrier claims the wrong period

Coverage disputes often come down to minutes. A driver may claim the app was off, or the insurer may claim the driver had not accepted the ride yet.

The insurer requests the wrong claim path

Rideshare claims can involve multiple policies: the driver’s personal policy, the TNC policy, and sometimes UM/UIM depending on the situation.

How to protect yourself after a rideshare crash

Document the ride details

Save screenshots, trip receipts, timestamps, and driver information.

Get medical care and keep a clean timeline

The medical record is still the foundation of damages.

Be careful with recorded statements

Let the evidence establish the timeline and fault.

Frequently asked questions

Does rideshare insurance always provide $1 million?

Not in every period. Texas law requires $1 million during a prearranged ride, and lower minimum limits apply while the driver is logged on and waiting.

What is the most important fact in a rideshare claim?

The driver’s app status at the moment of the crash.

Can the rideshare company deny coverage?

They may try. That is why the trip timeline and app data matter.
