A wrongful death lawsuit has been filed against Atmos Energy after a deadly natural gas explosion and fire at the Clyde Apartments in Oak Cliff killed three people on May 28, 2026, according to NBC 5 DFW.
The lawsuit was filed on behalf of the victims’ family, including a 10-year-old girl who survived after crawling out from the rubble.
According to NBC 5, the lawsuit alleges Atmos Energy failed to properly mark gas lines and failed to respond to reported gas leaks in or around the Clyde Apartments before the deadly explosion. The lawsuit claims gas built up until contractors, who had reportedly called 811 before digging, struck an unmarked gas service line.
NBC 5 also reported that the National Transportation Safety Board’s preliminary findings cited that the gas line struck on May 28 had not been marked. The lawsuit further alleges Atmos “habitually mismarked” gas facilities in the area.
This is a devastating case because apartment residents rely on utility companies, property owners, contractors, and locating services to follow basic safety rules designed to prevent gas explosions. When natural gas lines are not properly located, marked, repaired, or monitored, the consequences can be catastrophic.
Why This Matters
Natural gas explosion cases require an immediate and aggressive investigation. Important evidence may include 811 call records, gas line locate tickets, utility maps, leak reports, maintenance records, prior complaints, contractor communications, inspection records, emergency response records, surveillance video, witness statements, and the findings of local, state, and federal investigators.
In a wrongful death case involving a gas explosion, investigators may need to determine whether a utility company knew or should have known about leaking gas, whether gas lines were accurately mapped, whether lines were properly marked before excavation, whether residents were warned, and whether the responsible companies followed required safety procedures.
These cases can also involve multiple potentially responsible parties, including utility companies, apartment owners, property managers, excavation contractors, subcontractors, line-locating companies, maintenance companies, and others involved in the work or safety decisions leading up to the explosion.
Families who lose loved ones in preventable explosions may have the right to pursue compensation for funeral expenses, loss of companionship, mental anguish, loss of support, loss of inheritance, and other damages available under Texas law. Survivors who suffer burn injuries, fractures, smoke inhalation, traumatic brain injuries, emotional trauma, or other injuries may also have claims for medical bills, pain and suffering, impairment, disfigurement, and future care.

Frisco Mother Advocates Against Impaired Driving
As summer travel and holiday celebrations increase across Texas, the Texas Department of Transportation (TxDOT) has launched its annual “Drive Sober. No Regrets.” campaign to remind motorists of the devastating consequences of impaired driving. This year’s campaign honors Carly Beatty, a 19-year-old Texas A&M University student whose life was cut short after she was struck by an impaired driver while walking home in College Station in 2019. Carly, a sophomore majoring in animal science, dreamed of becoming a veterinarian. According to TxDOT and her family, she was walking home with friends when an impaired driver struck her. Despite extensive medical treatment, she later died from her injuries. Her mother, Sue Beatty, has partnered with TxDOT to share Carly’s story in hopes of preventing other families from experiencing the same tragedy. The campaign coincides with increased summer travel and encourages drivers to plan ahead, use a designated driver, or choose a rideshare instead of driving under the influence. According to TxDOT, impaired driving continues to claim hundreds of lives across Texas each year. Even small amounts of alcohol or drugs can impair judgment, reaction time, and the ability to safely operate a motor vehicle. The agency’s campaign serves as a reminder that every impaired driving decision has the potential to change lives forever. When an impaired driver causes a serious or fatal collision, preserving evidence is critical. Important evidence may include police crash reports, toxicology results, field sobriety testing records, dash-camera and surveillance footage, vehicle event data recorder (EDR) information, witness statements, cell phone records, and accident reconstruction evidence. Acting quickly can help ensure that this evidence is preserved before it is lost or destroyed.
