A 59-year-old woman was killed in a head-on crash on Interstate 45 in Conroe after police say a pickup truck traveled the wrong way in the northbound lanes early Sunday morning.
Conroe police identified the woman as Emelia Muniz.
Police began receiving reports of a wrong-way driver at approximately 4:40 a.m. Callers reported seeing a dark-colored pickup traveling south in the northbound lanes of I-45. One caller told dispatchers the pickup appeared to be traveling about 100 mph.
Within minutes, police began receiving calls reporting a major crash involving the pickup and a white SUV near the Highway 105 exit.
Muniz, who was driving the SUV northbound, died from her injuries at the scene.
The 20-year-old pickup driver was taken to a hospital and was reported to be in stable condition.
What Happened in the Fatal I-45 Wrong-Way Crash?
According to Conroe police, preliminary information indicates that the pickup was traveling southbound in the northbound main lanes of I-45 in the 1000 block of South I-45.
The pickup then collided head-on with Muniz’s northbound SUV.
Both vehicles sustained major front-end damage.
Police are continuing to investigate why the pickup was traveling the wrong direction on the interstate.
Police Investigating Whether Intoxication Played a Role
Conroe police said investigators are working to determine whether intoxication contributed to the fatal collision.
The Montgomery County District Attorney’s Vehicular Crimes Unit was also called to assist with the investigation.
At this stage, authorities have not announced that intoxication caused the crash or that criminal charges have been filed.
The investigation remains ongoing.
Why Wrong-Way Highway Crashes Are Often Especially Severe
Wrong-way crashes on interstate highways can be particularly dangerous because they frequently involve vehicles approaching each other at highway speeds.
Unlike many rear-end or sideswipe collisions, a head-on wreck can combine the forces of two vehicles moving in opposite directions.
Investigators in a fatal wrong-way collision may examine:
Vehicle speeds before impact
Where and when the wrong-way driver entered the highway
Traffic-camera and surveillance footage
Witness statements and 911 calls
Vehicle electronic data
Cellphone records when legally relevant
Alcohol or drug testing
Police body-camera and dash-camera footage
Roadway signs and pavement markings
The drivers’ actions immediately before the collision
In this case, the reports from motorists who saw the pickup before the crash may become especially important in reconstructing its route and speed.
The Reported 100 MPH Speed May Be Important Evidence
One caller reportedly told dispatchers that the wrong-way pickup was traveling approximately 100 mph before the collision.
That report is based on a witness observation and should not be treated as a final determination of the pickup’s exact speed.
Investigators may be able to obtain more precise information from vehicle event data, crash reconstruction, roadway evidence, video footage, or other sources.
Electronic data may show information such as vehicle speed, braking, throttle position, and other conditions immediately before impact.
Evidence That Should Be Preserved After a Fatal Wrong-Way Crash
A wrongful-death investigation may involve evidence beyond the initial police crash report.
Potentially important evidence can include:
911 recordings
Traffic-camera footage
Nearby surveillance video
Vehicle event data
Crash-scene photographs and measurements
Witness statements
Toxicology evidence
Cellphone records when appropriate
Police body-camera footage
Medical and emergency-response records
Video and electronic evidence can sometimes be overwritten or lost, making prompt preservation important after a serious collision.
Wrongful Death Claims After a Fatal Texas Car Wreck
When a person is killed because of another person’s negligence, certain surviving family members may have rights under Texas wrongful-death law.
Depending on the circumstances, recoverable damages may include losses associated with financial support, companionship, mental anguish, and other damages permitted under Texas law.
A separate survival claim may also exist for damages the deceased person experienced between the injury and death, depending on the evidence.
A criminal investigation and a civil wrongful-death claim are separate matters. A family does not necessarily have to wait for the criminal investigation to be completed before investigating potential civil claims.
How a Texas Car Wreck Lawyer Can Investigate a Wrong-Way Crash
A serious wrong-way collision may require an independent investigation in addition to the work performed by law enforcement.
A Texas car accident lawyer may seek to preserve vehicle data, obtain 911 calls and available video, interview witnesses, examine insurance coverage, review toxicology evidence when available, and work with experts to reconstruct how the collision occurred.
